Restaurant owner pleads guilty to tax fraud

SCHENECTADY, N.Y. -- A local restaurant owner admits to tax fraud. According to the Schenectady district attorney, Frank Popolizio pled guilty to one count of third degree criminal tax fraud.

Popolizio faced an 11 count indictment after being accused of consistently failing to file sales tax returns for his restaurant, the Pentagon 1978, on Erie Boulevard. Investigators said he did not pay taxes from September 2009 through February of this year. He faces one to three years in prison, and must pay more than $98,000 in restitution.
